These Terms of Service (“Terms”) govern your use of the CompyGo inventory management mobile application (the “App”) developed and operated by Deniss Kolesins (“we”, “us”, or “our”).
By downloading or using the App, you agree to these Terms. If you do not agree, please do not use the App.
1. Use of the App
- Eligibility: The App is intended solely for users who are at least eighteen (18) years of age (or the age of legal majority in your jurisdiction). By downloading, installing, or using the App, you represent and warrant that you are at least 18 years old and legally competent to enter into these Terms. If you are under 18, you are strictly prohibited from using the App.
- License: We grant you a personal, non-exclusive, non-transferable, limited license to use the App on your mobile device for your personal or internal business inventory management (including creating items, managing text data, and uploading images).
- Prohibited Actions: You agree not to attempt to decompile, reverse engineer, modify, or extract the source code of the App or its associated backend services.
2. User Accounts and Data
- Registration: The App requires authentication via Google Sign-In or supported OAuth methods using your email address. You confirm that the account used belongs to an adult (18+). You are solely responsible for maintaining the confidentiality and security of your account credentials.
- Data Ownership: You retain all ownership rights to the inventory items, description text, images, and content you upload to the App (“User Content”).
- Media and Storage:
- Free Mode: In the free mode of the App, your User Content (including images, text, and inventory records) is stored locally on your device or backed up to your personal Google Drive storage via integrated cloud backup functionality. We do not store or host your User Content on our servers in Free Mode, and we are not responsible for data loss arising from deleted files, insufficient cloud quota, or Google Drive service interruptions.
- Paid Subscription Mode: In the paid tier/subscription mode, your User Content (including uploaded photos and inventory records) is stored, synced, and hosted on our secure backend servers to enable cloud features. While we implement standard industry practices to secure and backup server data, you are encouraged to maintain independent copies of important records and media.
3. Subscriptions and Payments
- Billing and Auto-Renewal: Access to certain premium features (such as backend cloud synchronization and server-side storage) requires a paid subscription. Subscriptions are billed on a recurring basis (monthly or annually) through your Google Play Store account. Your subscription will automatically renew unless canceled at least 24 hours before the end of the current billing period, or in accordance with Google Play’s current cancellation policy.
- Management and Cancellation: You can manage or cancel your subscription at any time through your Google Play account settings. Canceling a subscription will disable paid backend cloud features at the end of the current billing cycle.
- Refunds: All purchases and subscription payments are processed directly by Google Play. Refund requests are governed by the official Google Play Refund Policy and must be submitted through your Google Play account interface.
- Price Changes: We reserve the right to modify subscription pricing at any time. Any price changes will be communicated in advance and will take effect at the start of the next billing cycle.
4. Third-Party Services
The App integrates with third-party services to provide core features and support:
- Google Authentication (OAuth) & Google Drive: For secure sign-in, account verification, and optional backups.
- Crisp: For in-app customer support chat (optional for users to interact with).
Your use of these integration features is subject to the respective terms and privacy policies of Google and Crisp. We are not responsible for the availability, uptime, or functionality of these third-party platforms.
5. Intellectual Property
All rights, titles, and interests in the App (excluding user-provided data), including its design, code, and trademarks, are the exclusive property of Deniss Kolesins and its operators.
6. Disclaimer of Warranties
The App and its backend services are provided on an “AS IS” and “AS AVAILABLE” basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including but not limited to uptime guarantees, fitness for a particular purpose, and non-infringement. We do not guarantee that the App or backend server will be uninterrupted, error-free, or continuously accessible.
7. Limitation of Liability
To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of data, photos, inventory records, or profits — arising out of your use of, or inability to use, the App or backend services.
8. Account Termination and Deletion
- By You: You may stop using the App at any time. You can request the deletion of your account and associated server data by using the in-app deletion option or by sending an email request to [email protected].
- By Us: We reserve the right to suspend or terminate your account and access to the App or backend services at our sole discretion, without prior notice, if you breach any provision of these Terms.
9. Changes to Terms
We reserve the right to modify these Terms at any time. Updated Terms will be effective immediately upon posting within the App or on the App’s official listing page. Continued use of the App following any changes constitutes your acceptance of the updated Terms.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Latvia (or your country of residence), without regard to its conflict of law provisions.
